Employment-Based Immigration: first Preference EB-1

You might be qualified for an employment-based, first-preference visa if you are an alien of amazing capability, are an exceptional teacher or researcher, or are a certain international executive or supervisor. Each occupational classification has specific requirements that should be fulfilled:

Your petitioning employer needs to be a U.S. employer and mean to employ you in a managerial or executive capability. The petitioner should have been doing company in the U.S. for a minimum of 1 year, as a legal entity with a certifying relationship to the entity that employed you abroad in a managerial or executive capacity.

In order to show you have sustained national or international praise and that your have been acknowledged in your field of competence, you need to either consist of evidence of a one-time achievement (significant internationally-recognized award) or 3 of the 10 noted criteria listed below (or similar evidence if any of the requirements do not readily apply):

– Evidence of receipt of lesser nationally or worldwide acknowledged rewards or awards for quality

– Evidence of your subscription in associations in the field which require outstanding accomplishment of their members

– Evidence of released product about you in expert or major trade publications or other significant media

– Evidence that you have actually been asked to evaluate the work of others, either individually or on a panel

– Evidence of your initial clinical, academic, creative, athletic, or business-related contributions of major significance to the field

– Evidence of your authorship of academic posts in expert or major trade publications or other significant media

– Evidence that your work has actually been shown at creative exhibits or displays

– Evidence of your performance of a leading or critical function in recognized organizations

– Evidence that you command a high income or other substantially high remuneration in relation to others in the field

– Evidence of your commercial successes in the performing arts

In order to demonstrate you are an exceptional professor or scientist, you need to include proof of 2 of the 6 listed criteria listed below (or similar evidence if any of the requirements do not readily use):

– Evidence of invoice of significant prizes or awards for outstanding accomplishment

– Evidence of subscription in associations that require their members to show impressive accomplishment

– Evidence of published product in professional publications composed by others about the alien’s work in the academic field

– Evidence of involvement, either on a panel or separately, as a judge of the work of others in the same or allied academic field

– Evidence of initial scientific or scholarly research study contributions in the field

– Evidence of authorship of scholarly books or articles (in academic journals with international flow) in the field

Application Process

Extraordinary Ability: You might get yourself by submitting a Type I-140, Petition for Alien Worker.

Outstanding Professors and Researchers: Your U.S. company should submit a Form I-140, Petition for Alien Worker. As part of the application procedure, your employer should be able to show a continuing capability to pay the used wage since the top priority date. Your employer may utilize an annual report, federal earnings tax return, or audited financial statement to show a continuing capability to pay your wage.

Multinational Manager or Executive: Your U.S. company should submit USCIS Form I-140, Petition for Alien Worker. As part of the application procedure, your employer must be able to demonstrate a continuing capability to pay the offered wage as of the concern date. Your employer might use an annual report, federal income tax return, or audited financial declaration to demonstrate a continuing capability to pay your wage.
