Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights include:- Spend for all earnings earned (INFO # 3) at the rate agreed to by the company and job staff member.

– Pay of a minimum of base pay (INFO # 1), the relevant Colorado or regional base pay, job and job all earned overtime earnings without impermissible reductions from their incomes;.

– Pay of all made salaries without impermissible deductions (INFO # 16).

Labor Statutes, job Rules, & Published Guidance

Statutes & Rules: DLSS implements a number of Colorado’s wage and hour and other types of labor statutes and labor guidelines, job consisting of the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please check out the Division’s Labor Statutes and Labor Rules websites for existing and prior versions of key Colorado labor statutes and guidelines.

Published Guidance: The Division’s primary kinds of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally approved notifications, viewpoints, and descriptions on various labor law topics; and.

– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for employees on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you wages, you can send your employer a composed demand for payment of salaries by mail, email, text message, or other electronic methods. A written demand may be sent to the company at the same time a Labor Standards Complaint Form for unsettled incomes is filed with the Division. The Labor Standards Complaint Form can be discovered on our Demands, Complaints, Responses, and Settlements web page.

Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and evaluated, a letter explaining the nature of the problem and the quantities alleged to be owed is sent to the company. Investigations Launched by the Division (” Direct Investigations”): The Division may direct investigations of prospective infractions of Colorado wage and hour law. If you want to submit an idea, please email the Division at cdle_di_tips@state.co.us. If you want to file a private claim for unsettled wages, you must fill out a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct investigation citation or several Notices of Assessment, an alleged employer might send a Direct Investigation Appeal Form.
